Introduction

The websites (collectively, the “Website”), all other products and services, including mobile applications, owned, controlled or offered by Hey, Inc. and all content offered as part thereof, are collectively referred to herein as the “Services.” Subscribers, account holders, customers, users, and others who download, access, use and/or subscribe to the Services (“you”) agree to the following privacy policy (the “Privacy Policy”). The Privacy Policy should serve as an accessible guide to the information we collect during your use of the Services. By using the Services, you agree to this Privacy Policy, and you represent that you are over 18 years of age.

Stewardship of Data

Hey, Inc. takes your data and privacy seriously. We know we are keeping your data on your behalf and for your benefit. We will implement commercially reasonable and appropriate practices and standards to safeguard your data and protect it from attackers. Your content belongs to you and we are storing it on your behalf, so if you request, we will erase all trace of your data accessible to us. We allow you to opt out of storing your data with us, by disabling “Cloud-Sync” under the Settings menu of the HeyDay application – in that case, all of your pictures and data will then be stored locally on your mobile device and we will only continue to store on our servers those pieces of data necessary to provide the Services. Disabling “Cloud-Sync” will not delete data already collected and uploaded to our servers, but we will delete this information within seven (7) business days if you contact us and request us to do so. We understand the importance of privacy and security to our users and have made them a priority.

Collected information provided by you

We may ask you for certain pieces of information about yourself in order to provide the Services, which includes your e-mail address, name, phone number, your location, your photos and a list of your friends. All of this user-provided information is optional.

Automatically Collected Information

Hey, Inc. will also collect certain pieces of information automatically and passively in order to provide the Services. This will typically include browser, mobile operating system or platform type, IP address, referring site, list of search terms entered, list of advertisements clicked on, and the date and time of each visitor request. Hey, Inc. collects this data to best serve its users. This information will never be released on an individual basis. If location services are enabled on your mobile device, our HeyDay application will passively and automatically send location information to Hey, Inc. in order to for us to deliver location-specific information to the HeyDay application on your device and compile your individualized timeline. If you disable “Cloud-Sync” under the Settings menu of the HeyDay application, Hey, Inc. will only store this information on an anonymous basis in our servers. Disabling “Cloud-Sync” will not anonymize data already collected and uploaded to our servers, but we will anonymize this information within seven (7) business days if you contact us and request us to do so. Hey, Inc. may also use cookies to track a user’s login information and interactions with the Services. A “cookie” is a small piece of data containing a unique identification number that is sent to your browser from a web server, and is stored on your computer's hard drive. The unique ID number identifies your browser to Hey, Inc.’s computers whenever you visit. Cookies do not enable anyone to access personally identifiable information that you have not already given us. Hey, Inc. primarily uses cookies to connect members with account information stored on Hey, Inc.’s computers. This helps Hey, Inc. deliver better and more personalized service. Cookies are part of the technology implemented by your browser. Most browsers are initially set up to accept cookies You can reset your browser to either notify you when you have received a cookie, or to refuse them all together. If you disable or reject cookies, some of the functionality of the Services may be disabled or inaccessible. Additionally, Hey, Inc. collects information from its mobile application users who have installed the HeyDay application in a similar manner to optimize the mobile experience. Any entries made on the mobile application will be used to enable and optimize the Services, manage accounts, for research and analysis, to communicate with users and to develop content. This information will never be released on an individual basis, but may be released in a compiled manner.

Use Of Collected Information

Hey, Inc. believes that the privacy of its users is paramount and strives to use their data only in ways outlined in this Privacy Policy. Most uses of data are for internal purposes only. Hey, Inc. may occasionally inform users of new releases and features via any communication method you have provided to Hey, Inc.

Third Parties: Hey, Inc. may engage certain service providers for additional features, such as hosting. Hey, Inc. will thoroughly examine the privacy policies of partners to ensure that its users’ data is safe and taken care of responsibly. Third parties will not be able to use your information in ways that are prohibited by the Hey, Inc. Privacy Policy. However, Hey, Inc. is not responsible for the privacy policies and/or practices of such third parties.

Transfers: Hey, Inc. may disclose certain information in the event that it is merged, acquired, sold, or some of its assets are acquired. Hey, Inc. will endeavor to ensure that the entity who receives your information treats it in accordance with this Privacy Policy.

Law Enforcement: Hey, Inc. will cooperate with law enforcement and disclose any requested information if they believe, in good faith, that such disclosure is necessary to: (i) handle fraud, attacks against our systems, or security conflicts, (ii) remain in line with currently applicable state and federal laws or regulations, (iii) continue to abide by our Terms of Service, or (iv) protect the public or Hey, Inc. from any attacks against intellectual or physical property rights. However, Hey, Inc. will endeavor only to disclose information requested via a valid legal process, and will endeavor to notify any user about whom they have disclosed information if possible.

Your Responsibility Online

Hey, Inc. places a premium on protecting your information and uses reasonable measures to protect your information, but you should remain aware that any information you share online can be accessed by others. Hey, Inc. is not responsible for the actions of those who obtain your content in this manner. Hey, Inc. cannot guarantee your safety and security and you should be aware that submitting any information and using the Services is done at your own risk.

Managing Your Privacy

We keep your data on your behalf and for your benefit. You can correct or delete your account information on the Services or by e-mail at privacy@hey.co, which you may also access for further assistance and questions regarding the Privacy Policy or for a copy of your account data. If you cancel your account or request us to delete your information, Hey, Inc. will limit its access to personally identifiable data to perform what is requested by you and will delete all traces of your information accessible to Hey, Inc. within seven (7) business days.

Jurisdiction

All information passed through Hey, Inc. is primarily handled in the United States but may from time to time be handled in any country in which Hey or its affiliate companies maintain facilities. By using the Services, you agree that the handling of your personal information and any communication through the Services will be governed by the laws of the United States and any applicable state laws.

Changes To The Privacy Policy

Although most changes are likely to be minor, Hey, Inc. may change its Privacy Policy from time to time, and in Hey, Inc.’s sole discretion. Hey, Inc. encourages visitors to frequently check this page for any changes to its Privacy Policy. However, if there is a major change to our Privacy Policy, we will notify you. Your continued use of the Services after any change in this Privacy Policy will constitute your acceptance of such change.
